Introduction / Acceptance of Terms

Welcome to stamp puncher. These Terms of Use ("Terms") govern your access to and use of the stamp puncher mobile application for iOS (the "App") and related services (collectively, the "Service") provided by stamp puncher ("we," "us," or "our"). By downloading, installing, accessing or using the App, you agree to be bound by these Terms and our Privacy Policy, available at https://stamp-puncher-1.forvibe.app (the "Privacy Policy"). If you do not agree to these Terms, do not use the App.

Description of Service

• stamp puncher is a creative utility app that transforms photos into digital stamps with perforated edges and customizable effects. Features include:
  • Importing photos and media from your device via PhotosUI.
  • Precise cropping to a fixed stamp aspect ratio.
  • Artistic emboss and deboss effects and other image adjustments.
  • An interactive digital notebook to organize, arrange, and customize your stamp collection.
  • Options to share created stamps as allowed by the App and applicable platform sharing features.
• The App is offered on a freemium basis: basic features are available for free; premium features require a subscription purchased through Apple’s in‑app purchase system (StoreKit).
• The App is not intended for children. See "Children" below.

User Accounts & Registration

• To use certain features you may be required to register for an account or sign in using an account management mechanism provided in the App.
• When creating an account you must provide accurate and complete information, and you agree to keep that information current.
• You are responsible for safeguarding your account credentials and for any activities that occur under your account. Notify us immediately at stamp-puncher-1@forvibe.app if you suspect unauthorized use of your account.
• We may suspend or terminate accounts that are inactive, fraudulent, or in breach of these Terms.

User Obligations & Acceptable Use

• You agree to use the App only for lawful and authorized purposes and in accordance with these Terms.
• Prohibited conduct includes, but is not limited to:
  • Uploading, creating, or sharing content that is illegal, sexually explicit involving minors, violent, defamatory, infringing, hateful, discriminatory, or otherwise objectionable.
  • Infringing intellectual property, privacy, or publicity rights of others.
  • Attempting to access, tamper with, or disrupt the App, servers, or networks (including reverse engineering, decompiling, or bypassing security).
  • Attempting to interfere with other users’ use of the Service or harvesting data from the Service.
  • Using the App to create or distribute malicious code or to facilitate illegal activity.
• You represent and warrant that you own or have all necessary rights, licenses, and permissions to the photos and other content you upload, and that your content complies with these Terms and applicable law.
• You must comply with all App store rules and device manufacturer requirements when using the App.
• Children: The App is not intended for children. Do not create an account or provide personal information if you are under the minimum age required by your jurisdiction (for example, under 13 in the United States) unless you have the consent of a parent or legal guardian. If we learn we have collected personal information from a child in violation of applicable law, we will take steps to delete that information.

Intellectual Property Rights

• Unless otherwise indicated, stamp puncher and/or its licensors own all right, title and interest in and to the App, its content, design, text, graphics, logos, trade names, trademarks and software, and all intellectual property rights therein (the "Company IP"). These Terms do not transfer ownership of Company IP to you. All rights are reserved.
• Your Content: You retain ownership of any photos, images and other content you upload or submit through the App ("User Content"). By uploading or submitting User Content, you grant stamp puncher a non-exclusive, worldwide, royalty-free, sublicenseable, transferable license to host, store, use, reproduce, modify, create derivative works of, communicate, publish, and display such User Content solely for the purpose of operating, providing, improving, promoting, and marketing the Service and enabling sharing features you elect to use. This license continues even if you stop using the Service, but you may request deletion consistent with our Privacy Policy and these Terms.
• Feedback: If you provide feedback, suggestions, or ideas about the App, you grant stamp puncher a non-exclusive, worldwide, royalty-free license to use and incorporate such feedback into the App without compensation to you.

Disclaimers & Limitation of Liability

• Disclaimer of Warranties: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, stamp puncher DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE.
• No Guarantee: We do not guarantee that the Service will be uninterrupted, secure, error-free, or free from loss, corruption or unauthorized access. The appearance and quality of generated stamps are subjective and will vary.
• Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL stamp puncher, ITS AFFILIATES, LICENSORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION) ARISING OUT OF OR CONNECTED WITH THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO stamp puncher FOR ACCESS TO THE SERVICE IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY (OR, IF YOU HAVE NOT PAID ANYTHING, ONE HUNDRED U.S. DOLLARS (USD $100)), TO THE EXTENT PERMITTED BY LAW.
• Some jurisdictions do not allow limitation of liability or exclusion of certain warranties; to the extent such laws apply, some of the above exclusions may not apply to you.

Subscriptions & Payments

• Freemium Model: The App provides free features and optional premium features delivered via subscription(s) purchased through Apple’s in‑app purchase system (StoreKit).
• Billing & Auto‑Renewal:
  • Subscriptions are billed through your Apple ID account and will auto‑renew at the then‑current subscription price unless auto‑renew is turned off before the end of the current billing period.
  • You may manage, change, or cancel your subscription through your Apple ID account settings. For billing inquiries, refunds, or cancellations, please contact Apple Support; we do not process refunds for in‑app purchases made through the App Store.
  • By subscribing you authorize payment to the extent authorized by Apple and agree to applicable fees, taxes and charges.
• Free Trials & Promotional Offers: Free trials (if offered) convert to paid subscriptions automatically unless canceled before the trial period ends. We may limit promotional offers to one per user or Apple ID, and we reserve the right to modify or discontinue promotions.
• Price Changes: We may change our subscription prices. Price changes will take effect at the next subscription renewal after notice to you in the App or via your registered contact method, unless otherwise required by applicable law.
• Third-Party Payment Processors: All payments for subscriptions are processed via StoreKit / the App Store. We do not receive or store your payment card details; Apple manages payment processing in accordance with Apple’s terms.

Third-Party Services

• The App integrates with third-party services, including PhotosUI for photo import and StoreKit for payments. Your use of those third-party services is subject to their terms and policies. We are not responsible for the availability, performance, or content of third-party services.
• Photos and Media: The App requires permission to access your photo library (via PhotosUI) to import images. You control these permissions through your device settings. We process photos and media only as necessary to provide the Service and as described in our Privacy Policy.
• Third‑party content and links: The App may contain links to third‑party websites or services. We are not responsible for the content, practices, or privacy policies of third parties.

Termination

• Termination by You: You may stop using the App at any time. To delete your account or request deletion of your personal data, follow the in‑App account deletion process (if available) or contact us at stamp-puncher-1@forvibe.app. Deletion requests may take a reasonable time to process.
• Termination by stamp puncher: We may suspend or terminate your access, remove content, or cancel accounts for violation of these Terms, suspected fraud, illegal activity, requests from law enforcement, safety concerns, or technical issues. We may also terminate or suspend the Service, in whole or in part, at any time without prior notice.
• Effect of Termination: Upon termination, your right to use the Service ceases. Sections that by their nature survive termination (including Intellectual Property, Disclaimers & Limitation of Liability, Governing Law, and Changes to Terms) will continue in effect.

Governing Law

These Terms and any dispute or claim arising out of or in connection with them or the Service shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles. You and stamp puncher agree to submit to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California for disputes that cannot be resolved amicably.

Changes to Terms

• We may revise these Terms from time to time. If we make material changes, we will provide notice via the App, by email, or on our website before the changes become effective. The "Last Updated" date at the top of these Terms will reflect the date of the most recent revision.
• Your continued use of the Service after the Effective Date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Service.

Privacy and Data

• We collect and process certain data to provide the Service. The categories of data we collect include:
  • Photos and media that you import, upload or create within the App.
  • Financial information related to your purchases (processed by Apple/StoreKit); we may retain transaction records necessary for account management.
• We do not serve advertising in the App.
